By accessing or using HomeRES ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including contractors, businesses, and any other individuals who access the Service.
HomeRES provides Home Incentives & Performance (HIP) reports for residential and commercial contractors. Our platform generates analysis reports based on property data, scope of work, and environmental factors to help contractors evaluate their projects for resilience, energy efficiency, and sustainability.
To access certain features of the Service, you must register for an account. You agree to:
You may not create an account on behalf of another person or entity without authorization.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
HIP reports generated by the Service are based on data you provide, publicly available property information, and automated analysis. Report quality depends on the accuracy and completeness of the data you submit. HomeRES is not responsible for errors in reports that result from incomplete or inaccurate input data.
These reports are for informational purposes only. They do not constitute professional engineering, architectural, legal, or construction advice. You should consult with qualified professionals before making any construction, renovation, or investment decisions based on a report.
The Service and its original content, features, and functionality are owned by HomeRES and protected by applicable intellectual property laws. You retain ownership of any content you upload to the Service. By uploading content, you grant HomeRES a limited license to use, store, and process that content solely to provide and improve the Service. This license ends when you delete your content or close your account, subject to any retention obligations described in our Privacy Policy.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. HomeRES does not warrant that the Service will be uninterrupted, error-free, or completely secure, or that any reports will be accurate, complete, or suitable for any particular purpose.
To the maximum extent permitted by law, HomeRES will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.
In cases where liability cannot be fully excluded, HomeRES's total liability to you for any claim arising out of or related to these Terms or the Service will not exceed the greater of (a) the amount you paid to HomeRES in the 12 months preceding the claim or (b) $100.
By HomeRES: We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or if we discontinue the Service. We will provide notice where reasonably practicable, except in cases of serious violations.
By You: You may close your account at any time by contacting us at legal@homeres.ai or through your account settings.
After Termination: Upon termination, your right to use the Service ends immediately. We will handle your data as described in our Privacy Policy. You may request a copy of your project data before closing your account.
We may update these Terms from time to time. We will notify you of material changes via email or through the Service at least 14 days before they take effect. Your continued use of the Service after that date means you accept the updated Terms. If you do not agree to the changes, you may close your account before they take effect.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms will first be addressed through good-faith negotiation. If a dispute cannot be resolved informally, it will be resolved through binding arbitration in Los Angeles, California, except that either party may seek injunctive relief in court for intellectual property violations.
